A donor’s signature must be witnessed by: - someone aged 18 or over - not a named attorney or replacement attorney An attorney’s signature must be witnessed by: - someone aged 18 or over - who is not the donor Attorneys or replacement attorneys can witness each other’s signature but not the donor’s. Signatures can’t be witnessed online and must be done in person. I’m not sure if there is an LPA in place – how do I find out? If you’re not sure if there is an LPA in place, ask the donor or attorney first and see if you can use the ‘View an LPA service’. If this isn’t possible, you can request to search the OPG registers.
