What's a power of attorney 

A lasting power of attorney (LPA) in England and Wales is a legal document that lets you appoint trusted individuals to make decisions for you if you become unable or unwilling due to illness or an accident.

Reasons to set up a power of attorney

You can't set up a power of attorney after losing mental capacity, so plan ahead. This makes sure you can:

  • stay in control – choose who acts on your behalf to make sure someone you trust manages your affairs
  • avoid family disputes – make it clear who is responsible for making decisions on your behalf
  • save time and money – avoid the extensive legal process to gain guardianship if power of attorney isn't in place.

What happens if I don’t have a power of attorney?

  • Most people can grant powers of attorney – you just need the mental capacity to understand the implications of your decisions. You must also be 18 years or over in England and Wales, and 16 years or over in Scotland.

    You can choose more than one attorney. You can also choose different attorneys for property and financial affairs than for health and welfare-related decisions.
